This is a very sticky situation. A short while ago there was a similar case. Your insurance company bulted something into your contract so when you receive the compensation, you need pay back their medical cost first.

For example:
Your medical cost $15000
You received $99999
Attorney takes 1/3 $33333
Other attorney cost $1000

You will end up receive $99999-$33333-$15000-$1000

If you won less than $15000 then you end up losing money.
