my hu*****and used my car (I am the owner in the title) to teach someone driving. before started, we told that guy, if he crash the car, he should pay for it, and he agreed. the first time on the road, he crashed the bumper, the estimate of replacement would be $700~900. he only want to pay $200. yesterday when my hu*****and met him alone to get $200, he asked my hu*****and to sign a statement that we will not go after him later. My hu*****and signed it without my agreement.
My question is, I am the owner of the car, can I still sue him even my hu*****and signed that? legally Can I do that? my car is 9 years old, so we just ask him for $350, but he refused to pay that much and he asked my hu*****and to sign the statement otherwise he wouldn't give us the $200. that piss me off.
Thank you.
can I sue this in small claim court?
