A:出版的东西都是公开的。但是公开的不代表就是 public domain 了。

A:归纳,改写 is exactly what derivative works is about.

In the United States, the Copyright Act defines "derivative work" in 17 U.S.C. § 101:

A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a “derivative work”.

Q:要到何种改写程度才不能算derivative?

A:这是个 question of fact, 要打官司才能知道。 问题是,你愿意冒这个风险吗? 别忘了,人家是有版权的。 就算你愿意,你能找到愿意冒这个风险的出版社吗?

Q:你说“whether you have liability or not is a different question”又如何解释?

A:是否侵权和如何赔偿是两个概念。 当然了,侵权是赔偿的前提,但是这不代表侵权了就一定有赔偿。 如果那本书在美国没有注册,按照版权法的规定,作者也还是有版权的,因为有没有版权和有没有注册无关。 只要写出来,就有版权了。 但是如果他没有注册,就没权力告你侵权,也谈不上或得赔偿。 可是你的确是侵权了。
