my divorce case is so complicated,ask lao mao for help pls!

请教老猫和各位网友:

我现在的情况是:老公h1, 我h4,老公140已经批,他和我的485在2007年7月递上去了,他使主申请人.我有EAD 卡但没有工作,因为孩子还太小(一个快4岁,一个才7个月),老公在中国有了情人,想与我离婚并与她结婚,现正打算以B1身份让她先过来,可他又不想去美国法院起诉,因为不想付法院规定该付的抚养费.想与我在这里协议离婚.他年薪7万1,说最多付我们1千5一月,然后让我带两孩子回中国,如果不同意他的提议,则几个月后他将把工作辞了回国,然后他将在国内起诉离婚.
我呢,一是不是很想离,因为孩子太可怜,在说我现在也没有工作.要离我也希望拿到绿卡(.他的PD是2006年10月,不知可能还要等多久?)可他就是想趁他律卡批之前离了好给她办绿卡,.如果我回国,我也担心不一定找得到工作,万一他不付抚养费,而我又没有工作,那我们正的只能望洋兴叹了,等着饿死了.请老猫及各位指教我该怎么维护我和孩子的权益.万分感谢!
