Obviously the contract is not enforceable because it is over $500. It is in violation of statute of fraud.

The problem is, they have already dumped materials in your backyard. Even if the contract is voidable, what are you going to do? Are you willing to pay them to dig the material out? The best way to deal with it is to show the price is unreasonable.

$35 per yard sounds ridiculously high but you have to prove it. You need to find out from the first one whether the material is the same or substantially similar. Ask around others for the same quote, in writing of course. Your hope is to convince the court everybody charge a much lower price but this guy is way higher for the same material and negotiate for a better price.
