there's always an inherent risk in any litigation. and the law suit might end up costing you more. but I think you have everything you need to bring a law suit. the attorney is acting as your agent. therefore, the contract is not effective until it is sent to the seller. you should be able to withdrew the contract as long as it is not sent out. and you should certainly be able to modify it before it is sent out.

I would also complaint to the NY state bar. even though I don't think the lawyer would be sanctioned just for this, unless it is a repeated offense, as it is not something terribly bad on his ethics.
