借款

和孩子的爸爸闹离婚。在我俩没结婚前，他曾经给了我14000，帮我支付学费。当时说是让我拿钱支付学费，剩下的用作我的生活费好了。没说借，也没有借条。现在我俩离婚。他要我还这笔钱。并且在分居协议上写用给孩子的抚养费还。他着个要求合理吗？法院回这么判吗？
