Here is my case.
I stopped and signaled to make a left turn, a car from far behind hit the back of my car. It is 100% his fault, he got a ticket and I didn’t.
I was hit very badly, the car totally crashed and unable to repair. I was sent to the emergency room, after all kinds of check I was released from hospital about 3 hours later. I feel neck, shoulder and knee pain, you know this kind of problems usually doctors can’t tell what’s wrong. It cost about $3500. Later I visited some different doctors, therapist, and chiropractor, and acupuncture etc, total medical bill about $5500.
I hired a lawyer to represent me to deal with other party’s insurance company, now the insurance company gave me an offer for $10,000 to settle the case. (After the medical bill and attorney fee, I can get about $3600)
My lawyer said he normally would expect more money with this amount of medical bill, if I don’t accept this offer; we can go to the arbitration.
Here is the pros and cons for go to the arbitration.
Pros:
1. might get more money (but no guarantee)
Cons:
1. it takes time (another 6 month, it already takes 1 year to get here).
2. the person who does the arbitration works for the insurance company. (the court gave us 5 people to choose, my lawyer cross out 2 and insurance company cross out 2).
3. have cost ($1200)
