家庭暴利案，如何在criminal court撤诉?

老公暴力打伤我，在ER护士报警。我把他保释后，我已在民事庭（Civil)撤诉。明天我要到criminal couty(state Vs my hu*****and)上庭 ，不知老公会不会被判刑？我可不可以要求检察官撤诉因为我已经在民事庭（Civil)撤诉？还有法官一般会问什么问题？
