I heard the same story when I was in LA in 1997. My first test has highway and 2nd does not. They told me somebody was killed cos the student freak out on freeway.

The chance that examiner make stupid decision is very minimum because ultimately their life is on the line. Most cars that were driven in the test were compact. The protection is not that great.
