关于转换公司--旧公司罚款问题

我最近换工作，旧公司要罚将近 1 万元办身份的费用。
我觉得很不合理，请懂法律的朋友帮忙看一下。

现在情况如下：
我2006年8月进公司，工作到2008年5 月， 工作了将近2年。
现在要离开，公司要我赔偿 $9800 的移民费用。
公司说这 $9800 是我H1B 和绿卡申请的全部费用。
而且公司自动从我最后的paycheck里减掉了钱。我最后的paycheck包括3周的工资，和十天的vacation. 减了以后我还欠公司好几千块钱。

以下是我当时的合同有关部分：
Additionally， *** is assisting with your immigration to the United States and expects to incur cost of approximately $15,000 on your behalf in that connection. *** proposes to absorb 100 percent of those costs provided you do not resign from employment with *** for a period of three years, beginning on your hire date. Should you resign from your employment before the third anniversary of the hire date, you will be obligated to repay *** by the last day of your employment the applicable sum set forth as follows: if you quit on or before the first anniversary of your hire date, the sum of $15,000; if you quit on or before the second anniversary of the dire date, the sum of $10,000; if you quit on or before the third anniversary of the hire date, the sum of $5,000(or such other sum as is derived by subtracting $10,000 from the total costs incurred by us on your behalf).


现在有以下问题：
1。以上合同在法律上是否生效？公司是否有权利要这部分钱？
2。H1B 申请是否算应该算在这里？
我认为H1B不算移民费用，只有绿卡申请才算移民费用。请问是这样吗？
3。依照公司的合同，我是不是应该赔偿 2/3 的费用，因为我已经工作了一年多了。
4．公司是否有权利直接从我的paycheck里deduct， 是否应该尽我同意以后才拿钱。
