结婚五年，第三年买了房子，当时老公只放了他的名字，

现在他要回国发展，在什么都没谈妥的情况下就要卖房子，请问，这应该算夫妻共同财产，如果我不同意的话这房子能卖吗？还是只要他一个人签字就可以卖了？谢谢！
