求助：楼上的热水器坏了，把我的房间淹了

度假回来，发现房间淹的一塌糊涂。原因是楼上的热水器坏了。但楼上的保险公司说如果不是楼上的房主做错了什么，他的保险不会止付我的损失。我的保险公司同意支付我的损失。但我要付250 deductable。请问我可不可以要求楼上的房主支付deductable? 我住在colorado州
