How old is your kid? In US, mother usually gets physical custody, especially if the kid is young. No necessary to get your hu*****and an arrest record for that.

I would say, for your child's sake, even if you divorce, you should keep good relationship with your hu*****and. It is hard for a child to live with only mom or dad, it is even harder when the parent taught kid to hate each other. I would recommend you and your hu*****and to go through some kind of family consoling, which talks about harms done to kids when divorce [badly].
