紧急求助!

两个星期前车被别人撞了. 对方的错.当时叫了警察,这点没有争议.对方保险公司评估为:"Total loss".评估者的推荐理赔价为$6700+5%sale tax$335=$7050.我们那辆车的市场价大约在$7500-$8300.想想胳膊拎不过大腿, $7050 就算了.自己贴点钱再去买辆车算了.但问题在于现在保险公司坚持要扣除$335 的税.只赔给我们$6700.我们觉得太欺负人了.我们失去了我们的车(保险公司把我们的车当废车已经处理掉了);全家受到惊吓;身体受到轻伤;再买一辆车我们还得额外负担5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee...他们赔的钱根本就买不到一辆类似的车.保险公司的人说他们"公司就这policies.你不满意你去法庭告我呀."

实在是欺人太甚.如果我们想去法庭告他们的话,应该去什么法庭? 如果我们要求他们赔$6700加上5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee的话,有什么法律依据吗?他们一口咬定5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee...这些费用是你自己再买车的费用,跟他们无关.但其他保险公司的人都说5%sale tax是应该赔的.如果我们去small claim court的话,高限是$2000.我们的钱好象是超过了.我能只起诉5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee这部分吗?多谢哪位高人指点指点.
