Do you think it worth your time and energy? If so, talk to other lawyers. (You have to find a lawyer for this kind of case, no matter what people in this forum say.)

Personally, I think your time and energy is better spent on celebrating that you have a healthy baby and raising a happy and healthy child. At same time, you can file a complaint to State Health department about the incident.
