单身老猫是法律专家;STP 是税务专家,会计专业,与我同行。两位版主及其他大侠,正直善良,富有正义感,且足智多谋,经历丰富,为同胞排忧解难,在下深为感动。我的情况有点复杂,叙述可能啰嗦(为把事情说清楚),在下深深感谢各位的耐心阅读和指教。
我在国内是搞工程的。移民加拿大后,感觉自己有数字天赋,有不烦细琐的天性,因而学了个会计(硕士学历但没有学位)。去年(2006)夏天毕业后,应朋友之邀来到一小城镇(1万多人,95% 以上是白人,华人屈指可数)。
当时发简历找工作,把自己定位在追求CGA (Certificate General Accountant) 上。当时,当地一有名的CGA公司决定要我。但是Tom & Jack 公司(Tom 和 Jack是CA --- Chartered Accountant)找到我,说:“不要去CGA公司。我们是CA 公司,你可以成为CA。 我们公司有一Partner Z, 60 几岁了,几年后要退休,你可以接替他。”因而我去了Tom & Jack 公司。
Tom 是公司的大老板,40 多岁,忠厚老实勤劳;Jack 30 多岁,阴险奸诈,色鬼、酒鬼,虽然业务年限比Tom短很多,但业务水平比Tom高。Tom在单位是摆设。公司的筹划、运作,基本上是Jack 在操纵。
Tom & Jack 公司是小CA公司,无法竞争周边的三家大CA 公司。我想,Tom & Jack 公司的竞争对手,是那家有名的CGA公司,这可能是Tom & Jack 公司雇用我的原因之一吧。
加拿大西部几省的规定,只有在approved CA training 公司工作,才有资格进入CA program, 才有可能成为CA。2006年9月,我在网上查询,Tom & Jack 公司是approved CA training 公司。但是,现在在网上查询,2006年5月1日updated 版本,Tom & Jack 公司不在approved CA training 公司list 中。
2005年7月之前,Tom & Jack 公司只有4个员工 --- A, B, C, D,加上 Tom 和Jack ,共6 人。2005年7 月,Tom & Jack 公司购买了一CGA公司 --- YZ公司(Y退休,Z、M、N加入Tom & Jack 公司)。
N 50 岁,是个特别会来事的女人。2005年7月至2006年1月,N 在Tom & Jack 公司工作Part-time bookkeeper,2006年2月转为Full-time。2005年7月N加入Tom & Jack 公司之前,是像吉普赛人那样四方奔走,唱歌跳舞为生。加入Tom & Jack 公司后,她白天在Tom & Jack 公司上班,有时晚上在酒吧工作(唱歌跳舞),有时还去外地演出。今年7月1日加拿大国庆节,她在广场唱了几个小时,大出风头。
在雇用我之前,Tom & Jack 公司雇用了S --- 一个50岁的女人。S和我同一天开始上班(2006年9月18日,星期一),我Full-time,S Part-time。
2007年3月22日,星期四,16时半,Tom & Jack 找我谈话,说公司用我有风险,一是我英语不够好,二是我上班有时打盹。所以,他们决定让我离开此公司。Jack说,他愿意做我找工作的reference 。
他们问我有什么说的。这就意味着他们该说的,都说了,轮到我说了。
我说,“我讲三点。一,我感谢你们俩。如果我做有对公司有好处的事情,我很高兴;如果我有不足之处,请给我指出来。”Jack 插话,“关于你的好事,你很nice, 忠于雇主。”
我继续说,“二,关于英语,我面试时,你们知道我的水平,现在比那时应该好一些了吧。三,关于上班打盹,你两跟我讲过,如果我困了,我可以在厨房打个盹或出去走一走。”
Tom说,“有人说你上班做homework,把作homework的时间记在顾客头上。有人认为这是欺诈,不诚实。如果有人告到顾客那里,会有大麻烦。”
我说,“公司上班时间是9时至5时,我经常8时到6时走,多出的时间做homework,有何不可?”
最后,Tom叮咛我,只拿自己的个人物品。我明白他的好意。有人巴不得我拿公司的东西,这样他们就可以抓到我偷窃的证据。
他们给了我两周的notice pay, vacation pay.
3月23日,星期五,我去了Tom & Jack 公司。Tom正在与Z交谈。Tom招呼我。我说昨天Jack说愿意做我的reference。Tom说:“终止跟你的合同,code是M,这意味着他对你不高兴。”Z说:“你最好向Jack要封reference letter。”
我立马回家查M是什么意思。M是dismissal。
我随即在网上查询,加拿大几个中文网站,几乎都是说:dismissal 意味着拿不到EI (Employment Insurance)。
这个小城,任何一点事,很快就人人皆知。而且,N到处宣传。
一个朋友说,“我有许多雇员。3个月内,我可以解雇他们。3个月后,我就不能dismissal他们,除非员工犯有严重问题。所以这个事情很严重。我建议你采取legal action。”
我们商定,26日,我去找Jack, 要reference letter。如果他不给reference letter, 则向他要dismissal letter。
我说,“很可能reference letter , dismissal letter,两者他都不给。”朋友们说,“不可能。法律要求必须给dismissal letter。”
3月26日,星期一,我去找Jack。果然,Jack 什么都不给我。还说我没有任何benefit。
于是,我决定,如果我拿不到EI,我就采取legal action。还好,我拿到了EI。朋友们很吃惊,因为Jack在员工会议上说不给我EI。
这段时间,我看了些法律书。
Dismissal 有三种:summary dismissal :员工犯有严重错误,没有notice(即没有任何补助),没有EI; wrongful dismissal:员工没有严重错误,有notice,有EI; constructive dismissal。
我对Tom & Jack 公司没什么留恋的,我在Tom & Jack 公司也没有前途。
3月底开始,我发简历找工作。并给招人单位打电话。招人单位都很热情,说安排面试。但几天后,有的说招别人了;有的让我去面试,我开车几百公里去面试,但他们没有基本的诚意。
为什么会那样?招人单位给Tom & Jack 公司打了电话,Jack或其他人说了什么?
4月底开始,我为三家公司作会计。但我有言在先:“如果我找到了会计公司的工作,我会随时走。毕竟我要CA或CGA的牌子。”
我不想跟Tom & Jack 公司打官司。我想找个好工作。
每年8月至10月,是找加拿大会计公司工作的黄金期。
我写了个我在Tom & Jack 公司工作的情况说明(附后)。
请教各位大侠:
1. 下次我发简历找工作,可不可以附上我在Tom & Jack 公司工作的情况说明;
2. 如果不附上我在Tom & Jack 公司工作的情况说明,Jack 或其他人,说我坏话,怎么办?怎么解释:4月份是报税季节,一般情况是会计公司最忙的一个月,为什么我在3月底离开Tom & Jack 公司?
3. 如果附上我在Tom & Jack 公司工作的情况说明,如果让Tom & Jack 公司知道了,会有什么麻烦?会告我损坏他们的名誉,侵犯他们的隐私,等吗?我不怕他们告我诽谤,因为我讲的都是事实。
4. 其他方面。
3月底4月份,我承受很大的压力。为此,我写了篇文章“dare to struggle, dare to win” (附后),并在小范围内作了演讲。一来表明自己的态度;二来威慑Jack, N, Z。

I stay true to myself and others
--- About my work at Tom & Jack Inc. (Sep. 18, 2006 – Mar. 22, 2007)
Aug. 2006, Tom & Jack offered me a full-time job. The owners --- Tom and Jack said to me, “We are a CA firm, so you can become a CA; We have a partner Z who is over 60 and will retire in a few years, so you will replace him.”
I checked CA website (August 2006): Tom & Jack was on the list of the approved training CA offices. But in 2007, I did not find Tom & Jack on the list.
In Tom & Jack, before July 2005, there were 4 employees --- A, B, C, and D (receptionist). In July 2005, Tom & Jack bought an accounting firm YZ (Y was retired. Z, M, N joined Tom & Jack. N worked as a bookkeeper. She said she worked part-time from Jul. 2005 to Jan. 2006, and then worked full-time.).
Tom & Jack hired 2 employees --- I and S on the same day --- Sep. 18, 2006. I worked full-time. S worked part-time.
In the first week I worked, I entried transactions. I found the GST rate was wrong. Before July 1, 2006, GST rate was 7%; After June 30, 2006, GST rate is 6%. PST is 7%. To consider GST & PST, before July 1, 2006, the GST mixture rate was 6.5421% (= 7/107*100%); But after June 30, 2006, the GST mixture rate was not 5.6604%.
N said, “Z told me it’s 5.6604%. Z is a CGA for almost 40 years.”
I said, “I respect Z.”
A said, “I don’t know how to calculate it. We may ask Z again.”
I said, “It is 5.6075% ( = 6/107*100%).”
B asked me, “How did Z get 5.6604%?”
I said, “6/106*100% = 5.6604%.”
I respected Z. One day, Z came to me, “I have an emergency task. One of my clients is fined big amount. We went to Vancouver CRA office, but they refused to review. Then we went to Calgary CRA office. They also refused to review. We need to re-sort the material.” Facing boxes of disorder and complicated receipts, I was busy with them for almost two days. Later Z told me that CRA officers were happy, and just let the client pay several thousand of dollars. Z said to me “thank you very much!” many times.
In Sept. and Oct. 2006, most of my jobs were bookkeeping.
In the early Nov. 2006, Jack gave me a brand new company’s year-end job. N did the bookkeeping. I found the payroll had problem. Some cheques paid gross wages, not net wages; Many cheques were non-sense amount --- neither gross wages nor net wages.
Tom said, “You did the year-end wonderfully. You did most adjusted entries. The only mistake is this is interest receivable not cash. It’s cash but hasn’t got yet.”
Tom soliloquized, “Why did Jack give you a brand new company’s year-end job?”
I said, “I don’t know. Maybe he wanted to test me. If I do an old company’s year-end, I may refer to the prior year’s file.”
Then I did another year-end that N did the bookkeeping.
One day in Nov. 2006, Jack said to me, “Don’t put shit on N.” I said, “I am new here. I’m friendly to anyone. I don’t have any reasons to put shit on N or others. Look.” I gave him a paper that I did the payroll statistics. Jack fell down on the desk immediately, and said, “I need a new bookkeeper.”
About the payroll, some employees had many times’ advance wages in a month but deduction not enough.
Other companies’ bookkeeping N did was much worse.
During Dec. 2006 to Feb. 2007, most of my jobs were bookkeeping. For several companies, I did the whole processes from bookkeeping to year-end.
I with N, S was in an office room. Both S and N were about 50 years old.
Dec. 2006, N said to S (I did not hear the first part), “I worked here part-time before Feb., and then turned to full-time. Now you are part-time. It’s great chance to turn full-time. You should take vigorous action to strive for that.”
Then S bought food for N.
Jan. 2007, N told me, “This Friday will be the last day S works here. And I will leave the company very soon.”
Two days later, S said the company let her work here for another 2 months.
February 2007, N told me, “I will leave the company at the end of this month.”
March 2007, S said to N, “you ate lunch with your lawyer?” N said, “Yes.”
March 2007, N told me, “I will leave the company this month’s end. I will do bookkeeping at home.”
March 2007, Jack gave me a year-end with about 200 accounts. Jack did the bookkeeping.
At 16:40 March 22, 2007 (Thursday), before I left, Jack said, “I would like to be your reference.” I said to Tom and Jack, “I am grateful to both of you. If I did some good things to the company, I am happy that; If I have some weakness, please point out, so I can improve myself better.”
Jack said, “About your good things, you are a nice man; You are loyal to the employer.”
March 23, 2007 (Friday), I went to the office. Tom was talking with Z. Tom greeted me. I said, “Yesterday Jack said he’s like to be my reference.” Tom said, “Do you understand he is unhappy with you?” Z said, “You’d better ask him to give you a reference letter.”
March 26, 2007 (Monday), I went to ask Jack for a reference letter. Jack said, “No letter. Not I just say, “I love Kuan. He is wonderful.””
Jack said, “If you don’t want me as your reference, you can omit the experience. If you put the experience in your resume, it’s for sure that employers will phone us and talk about you.”
What bad words may some persons say about me?
1. My English is not good.
Everyone can have their own judgments.
I can communicate with others face to face or on phone. I can talk about any topics with people in English.
2. I slept during working time.
Yes, I admit it.
Tom and Jack said to me, “if you feel tired, you can have a nap at the kitchen or go outside for a walk.”
Just twice, I felt very tired. To be efficient, I had naps at the kitchen for a few minutes.
From now, I will not nap during working time.
There were 3 times of flu season. Sometimes only half of staff were at office. Only I was not sick during Sept. 2006 to March 2007.
3. I put my homework time to clients on the timesheets.
No, I don’t admit that.
I am a hard-work person. Most days I worked from 8 am to 6 pm at office (office hour is 9 to 5). I never put my homework time on my timesheet. The time I put on the timesheet was less than that I actually worked. From Sep. 18 to Dec. 22, 2006, I had no any homework, almost every day I worked from 8 to 6, I just put 7.5 hours a day on the timesheet.
Once, I put a time on the timesheet. Tom said, “It’s too tight. It should include set-up time.” He changed a bigger number into the timesheet.
My work time can compare to others’. I am confident that to a same or similar job, the time I spent was less than that others did.
4. I did not like bookkeeping jobs.
No, I don’t agree that.
Not disgusted with trivial details is one of my merits.
Jack said to me several times, “I am very happy that you don’t detest the boring accounting job.”
I did some investment job --- tracking investments --- entry transactions according to the investment statement. It is very boring work. Sometimes Jack asked me, “Have fun?”
In China, my major was fundamental engineering. Bookkeeping is the foundation in accounting. No good foundation, any thing could not be developing well.
5. Other fabricated or trumped-up words.
I will not admit them.

Dare to Struggle and Dare to Win
At 2 am, I woke up and got up. Then I opened the Bible randomly. It’s 1 Samuel Chapter 30, “David destroys the Amalekites.”
Now I report what I have gained from the chapter.
1. malicious and fierce enemies
(1). our enemies are evil
The Amalekites were evil. They wouldn’t dare battle against other armies. They just bullied and humiliated the weak --- children, seniors, and women.
I am new here, so some evils attack me.
The last sentence of verse 13: “my master abandoned me when I became ill three days ago.” This was irrefutable and conclusive evidence that the enemies did evil. In contrast, how did David treat the Egyptian --- the slave of an Amalekites? “They gave him water to drink and food to eat --- part of a cake of pressed figs and two cakes of raisins. He ate and was revived.”
(2). the enemies are sly
The Amalekites raided Ziklag when David and his men were not there.
(3). the enemies are vicious and greedy
The Amalekites had attacked Ziklag and burned it, and had taken captive the women and all who were in it, both young and old.
(4). the enemies are in feeble.
At that time, the Amalekites had about 8000 army, while David had only 400 men (another 200 men did not join the battle). But the Amalekites collapsed at a blow when David and his men hit out.
2. Trust God
Facing severe situation, how should we do? Weeping? Complaining? Or trusting God? The answer is obvious: trusting God.
3. destroy the evil
God gives us the righteous sword. With God, with the righteous sword, David and his men swept away all obstacles, and fought enemies from dusk until the evening of the next day.
4. how to treat fruits of victory
(1) all share Alike:
Verse 22 – 25: But all the evil men and trouble-makers among David’s followers said, “Because they did not go out with us, we will not share with them the plunder we recovered. However, each man may take his wife and children and go.” David replied, “No, my brothers, you must not do that with what the LORD has given us. He has protected us and handed over to us the forces that came against us. Who will listen to what you say? The share of the man who stayed with the supplies is to be the same as that of him who went down to the battle. All will share alike.” David made this a statute and ordinance for Israel from that day to this.
(2) giving some of plunder to friends: verse 26
(3) sending some to those who ever helped us: verse 27 – 30
5. what can we learn from the chapter
(1). We should be alert that Satan --- evil persons’ attacking us anytime and anywhere, especially when we are weak.
(2). Trust God.
(3). We should be brave and steady, firm and unshakeable.
(4). Generous, share plunder to others.
(5). God always gives us what we need. With God, we can defeat any enemies. Enemies attack us. It only makes us much closer to God, much stronger, and much wiser, just as the famous proverb says: Bees steal from flowers, but it makes flowers bloom much better. And the evil, always begin with injuring others, and end up ruining theirselves.
