邻居的风扇搅得我们无法睡觉

楼上邻居的风扇，不断造成我们卧室低频震动，搅得我们无法睡觉，几乎被他们逼疯。多次主动要求协商被粗鲁拒绝。找了公寓房东协调，也只能管用几天，接着又开始。无奈中我们报了警，警察来看过后说他们的行为不构成犯罪，警方无法介入。我们该怎么办？可以告他们吗？如果告，有多少胜算把握？通常诉讼费律师费会有多少？打官司费时费钱，不到万不得已，实在不想走这一步。
