单身老猫及各位请帮忙

我的地下室租给一人（其实是前屋主留下的），他很不nice，经常半夜make loud noises, 白天睡觉却嫌我们吵。一直在赶他走，最近他不给租金也不搬走， 已经有好几个月了。我们该怎么办？上法庭对我们有没有不利的影响（正在申请绿卡）？
