Expert's opionion needed - New House Contract

I entered into a contract to buy a new home (house yet to be built) and put down a 3% deposit to the builder. For some reason, I hope to get out of the contract without losing deposit. Is that possible? Does anybody have similar experience or suggestion? I live in the Bay Area.
