I still think married jointly or separately either way the spouse needs itin. I don't think itin can be obtained from outside US. Quote from W-7 instuction.
g. Dependent/spouse of a nonresident
alien visa holder. This is an individual who
may be claimed as a dependent or a spouse
on a U.S. tax return and who is unable, or not
eligible, to obtain an SSN and has entered
the United States with a nonresident visa
holder. For example, the primary visa holder
has a B-1 visa; the dependent or spouse has
a B-2 visa.
Similartome: you omitted the last half: and has entered
the United States with a nonresident visa holder.
