Not sure what to do on your second question. On your first one, it is hardly a surprise. I am not a litigator so I am not familiar with the procedures. But I think they will have to release the records under a subpoena, which is a written court order for the release of records. Try to go back to your court and ask the court/judge to issue a subpoena. You need to tell the court that is important to the case as she said the she receives no commission.
As I said before, I am not sure hwo to get the money back from the insurance thing. But I think you did the right thing by asking for it anyways in the suit.
