OPT will expire in June. My employer did not keep the promise that they would sponsor me on H-1B. I have been worked for them for more than eight months. Now they ask me to go because they realized that my current position and salary could not get me an H-1B. It is an American company. They do not want to take risk trying those possible solutions for me. How can I do now?
If my current employer or whoever finally sponsor me a 2005 H-1B, which at earliest will be valid on October 1, I would still not be able to legally work for three months. If I find another job and the new employer files a I-129 petition for me before the valid date of the H-1B sponsored by old employer, is the old H-1B still valid before the new H-1B approved? Can I go back China without any risk returning US before my new H-1B approved?
