Do I have the legal rights?
A few years ago I bought a toilet for $400. However the color didn't match my house so I never used it. My hu*****and thought it was too heavy and it took too much space to store, so we decide to sell it on Ebay. We got a buyer and shipped it out via UPS in the original box. When the buyer received the package it was already heavily damaged and was not acceptable. UPS sent the package back to us. Yesterday, the package arrived; I almost didn't recognize the box. It was dirty, had many scratches and the packaging was torn. My hu*****and called UPS to find out who was responsible for the damage, and they told him that we should have packed the item better. We were very upset with this because we had carefully inspected the toilet prior to shipping. Foam boards were used to provide support for the toilet, and we had made sure there was a “fragile” sticker placed on the box.
Has anyone else had similar problems with UPS? If so, how did you resolve your problem? I don't know what to do next. Am I supposed to just accept this loss?
