if you can get an seperation agreement, verything will be OK in US.

if both of you can go back to China, or have you legal representive, you can get divorce there. if both of you in US, you can get divorce in your county.

if one side does not agree to divorce, you have to seperate some time, in your case, just a few months depends on the state you live.
