很复杂的离婚,请教老猫先生,谢谢

曾经有过外遇在离婚前,之后提出离婚,在进入法律程序两个月后,和外遇斩断关系,(前后一共6个月).
虽然结婚七年,和丈夫的关系不好,他曾因为打我有个刑事案,但因为不重,被法庭裁决给我半年的保护令.
现正在办离婚,他有资财,我是学生,两个都是公民.
1)他起诉我婚姻欺诈,为了保护他的财产,问他可能赢吗?
2)对方在收集我以前外遇的证据,如果他能拿到人证物证,根据法律,我还能分到财产吗?
