The agreement you and your wife will get into is usually called separation and property settlement agreement, which is a contract. If parties choose to get an agreement, the court will incorporate the agreement into a divorce decree, which has the same effect of the order by the court. If a party wants to change it in the future, he/she has to approve the substantial changes in the conditions agreed before, otherwise, the court will not grant the motion for change.

It is a matter of negotiation in reaching the agreement, if you think the terms are too unfair which you could not accept, then, you should try another alternatives, maybe, going to court.
