1. you CAN sue school district for tort of negligence for physical injury your kid sustained and maybe pain and suffering (caused by delay) because the school failed to take reasonable care to your kid in the spatial and time boundaries of the schooling. the school nurse is also liable, but there may be governmental immunization. concult your lawyer for that.
2. to win your case, or convince your lawyer to take the case, find some witnesses ASAP before memory faded.
3. in case of no enough evidence, res ipsa loquitur may infer negligence of the school.
4. since lawsuit is time and money consuming, try settle first.
5. it does not matter if you kid would heal very well, the issue is who is responsible. even if your insurance company would pay for the medical expenses, collateral source rule allows you be compensated by the tortfeasor, even if you may be double paid.
