question to 木鱼头 about 超市保安的烦恼

Is that true, if not all 4 conditions (listed in your post) are satisfied, they cannot attest you?
I was arrested a while back ago simply because I forgot to check out one item (a DVD). I was not stealing, never even think about that (seriously), the reason that I forgot is because the DVD was slipped to the corner of the cart and I was in a hurry when checking out. And later I refused to sign the paper and pay the fine(maybe I should do that), then they called the police.

May I sue the super market in this case?

Any help will be highly appreciated!
