Urgent:H1B app. fee, can I sue

I had applied for H1B and was approved while I was employed. But my H1B will only become effective in June since my OPT expries in June and I used premium processing to dicdate the starting date of my H1B.

Now, I quit job due to a conflict with my employer and I believe they would not reimburse me for the visa application fee.

Can I find me a lawyer and sue the company?
(I think I will do this anyway since they owe me some compensation and bonus. Just want to know if the visa app. fee can be an item in the law suit.)

Also, can I ask the court to charge the company some penalty fees to cover the lawyer expenses?
If I cannot, then the money I get back will not be enough to pay my lawyer.
