Lao Mao, Thank you so much for your reply! Sorry I can't input Chinese in my office computer. After my I-485 interview, I received a letter from local USCIS. It says:
"notorial certificates of divorce must be accompanied by (1)the booklet(photocopy) issued by the appropriate civil authority reflecting the name of the divorced parties, the date of divorce, the registration number, and the date of issue. In addition, the booklet must indicate that the divorce was in according with the Divorce Law of People's Republic of China. And (2) the Household Register (photocopy) reflecting the entry."
The situation is: Since my hu*****and and his ex-wife’s representatives didn’t go to Jie Dao Ban Shi Chu to do the divorce, they didn’t have the booklet (离婚证的小本子). The only thing they got was the divorce certificate issued by the Court in China. They were in the U.S. when they got divorced.
Their names were removed (Zhu Xiao) from the 户口本 (household register) after leaving China. So their household Register (户口本) can’t reflect the divorce.
If I just provide some secondary evidence such as the testimony from Court, I am afraid that USCIS would deny my application. So I think that I have no choice to satisfy CIS’s request. Do you think my hu*****and can go to the Jie Dao Ban Shi Chu to get a 离婚证的小本子 based on the divorce certificate issued by the Court?
I heard that different states have different Divorce Law. I am living in CA. Do you know if CA's Divorce Law is favorable for my case?
Do you have any other suggestions? Looking forward to your reply! Greatly appreciated!
