我能不能代表我婶婶起诉？

我婶婶今年69岁，年轻时曾经昏迷一年之久，所以现在思路缓慢。

我叔叔几年前将她移民美国，然后趁她不再中国，就缺席审判和她离了婚。现在我婶婶孤身一人，国内也没有亲戚朋友。我叔叔只给她400一个月，付了房租，就所剩无几，就靠我平时接济照顾。

现在，我们已经到移民局拿到I864的副本。按规定，我叔叔要保证我婶婶年收入在贫困线125%以上。所以我们准备起诉。但是拿不出钱请律师。我们通过本地的legal aid,但是他们说对移民法没有经验，所以拒绝了。

我们想自己先起诉，然后申请法院判决被告方预付律师费。这样就有钱请律师了。但是问题是谁起诉比较好。如果我婶婶自己起诉，她到时候出庭时可能什么都讲不出。所以我能否代表她起诉。

下面一段是我从I864上的摘抄。请英语好的和学法律的大虾，看一看我是否算作private entity on behalf of the sponsored immigrant.

I understand that, under sectio 213A of the Immigration and Nationality Act (the Act, as amended, this affidavit of support constitutes a contract between me and the U.S Goverment. This contract is designed to protect the United States Government, and State and local government agencies or private entities that provide means tested public benefits, from having to pay benefits to or on behalf of the sponsored immmigrants, for as long as I am obligated to support them under this affidavit of support. I understand that the sponsored immigrants or any Federal, State, local or private entity that pays any means-tested benefirt to or on behalf of the sponsored immigrants are entitled to sue me if I fail to meet my obligations under this affidavit of support, as defined by section 213A and INS regulations.


另外我叔叔是开餐馆的，年收入至少10万。现在和一个比他小30岁的女人姘居。
