卖房子时withdraw?

在卖房子.跟一个买家关于价钱说的基本上差不多了.然后买家写了written contract发过来,这时我们不想卖了.

买家说要找律师,想知道他们可以告我们吗?房地产交易听说是within statute of frauds,那么没有书面合同,是不是就没有效力呢?
