STP, please help me with this tax issue

Dear STP,

My situation is 1/2001 to 9/2005 F-1, 10/2005 to 12/2005 H-1. More than $5000 wages were earned before 9/2005.

My hu*****and is a resident alien in 2005 and I want to select to file joint 1040 with him. Can I still claim the $5000 treaty benefit?
