Dispute Liability

各位大侠，小弟在温哥华。最近碰上一搓火之事，跟大家请教一下，也给大家提个醒。

一日小弟正要左转入一条小街的时候，后面一老外到马路对面的车道逆行超车，他的右车头撞在我的左侧前面靠轮胎处。我估计他当时是
走神了，正常人不会这么开车的。本来以为很简单的，没想到ＩＣＢＣ说，没名子的小街不算Ｈighway,是"alleyway"所以我拐弯的地方不算路口，因此判小弟输。理由是在非Intersection左转的，有责任确定安全才能左转。想想觉得怪怪的，在没有名字的路上，原来的交通规则不适用了？于是找来Motor Vehicle Act来看，它的Intersection的定义是：

"intersection" means the area embraced within the prolongation or connection of the lateral curb lines, or if none, then the lateral boundary lines of the roadways of the 2 highways that join one another at or approximately at right angles, or the area within which vehicles travelling on different highways joining at any other angle may come in conflict;

而Highway的定义是：

"highway" includes
(a)every highway within the meaning of the Highway Act,
(b)every road, street, lane or right of way designed or intended for or used by the general public for the passage of vehicles, and
(c)every private place or passageway to which the public, for the purpose of the parking or servicing of vehicles, has access or is invited;

其中并没有发现Alleyway的定义。我怎么看怎么觉得我转入的那条小街就是"Highway", 因为那里就是可以给大家走车的，而且还有交通标志，不许趴车，还写着"Lane contolled by speed bumps"。我问Adjuster, 他说"As the roadway is not named it is considered an alleyway and not an intersection. A highway is any roadway that is inviting to the public and that the public have access too."反正就是我不对就是了。我不明白的是，他们为什么不按Motor Vehicle Act来解释呢？请各位大侠给个主意，小弟值不值得化50块钱要求第三方expert来assess呢？因为小弟怀疑这expert也是保险公司请来的，会不会公证呢？有没有其他的选择？不知哪位兄弟姐妹有类似的经历？
