If you are working in the USA on a Visa( h1b, L1 or E1) and making more than $10,000 a year then you need to file income tax.

When you file your taxes, you should use 1040 regular form ˉ as resident. There are more items you can claim.

If you are not so sure, you should consult your accountant to determine your resident status.
