Urgent: 20,000 New H1-B Quota

Hi.

I graduated last year with a Master's degree and then worked for an American company for a year using OPT as they didn't want to sponsor visa.

Now I am almost employed by another company, but their immigration lawyer said the added 20,000 H1-B for Master+ degree could only apply to people in valid OPT period. Is that right?

I searched online and found no specific regulation about it.

Hope someone could help clarify it.
