stp, another question

I am afraid that niether of us qulifies as NRA. I did not get a F1/OPT. We are both using EAD derived from pending I485 case, although she WAS a H1 and I WAS a F1 before.

This question is actually for our 2002 return. We did get refund because of her filling as RA Head of Household and me filling as RA Married filling Seperate. I wish I had consulted you last year. We are definitely joint filling this year. But what do you suggest us to do for the year 2002? Should we let it go based on the ground that I live away from my wife, or should we fill 1040X to correct it? If we do, would it introduce audit and penalty?
