What Can I do ?

Hi, Friends,
Recently, A guy hit my car , I called a police and he provided the officer his auto insurance, when I was trying to contact his insurance agency several days later,I was told that his insurance was not active at the time when the accident happened. In other words, he was driving without insurance.

I called him and he sames does not want to pay me money for my car repair, I want to know what can I do ???

What kind of penalty he will receive once I report to the police or DMV. I am in California.
