Fetus would never be a person without redefining what a person is.  Currently a person has to be born. 

HOV requires two or more persons in a car.  Fetus is not a person.  Person has to be born. They could change the law to allow pregnant woman to be counted as two person.  That's not the same as treating fetus as a person.
