Mother herself does not have a claim to come to the States because her kid is a citizen.

The test rather is to protect the welfare of citizen child. Mother needs to petition to be treated as an exception under the rule. It is not automatic.

Since the child is not even in the States right now, it will be a high hurdle to file the petition.
