认真请教一个肖像权的问题

在美国的好多mall里面都要画画的人在作肖像生意，都在卖明星肖像画，当然都是花得较好的，也很逼真。请问真懂法律的高手，这究竟算不算是侵犯肖像权，如果算，为什么这么久都没有出过这方面的官司？
