我们在加州，我已经提出离婚申请。由于对方一直evasive, 比如不接电话，不回email, 不开门，所以费了很多时间才serve到他。分居期间，他基本不主动邀请小孩回去，我或者小孩提出了，才会在周末去呆半天。

 

律师建议file a supplemental declaration seeking monetary sanctions against him, meaning we want him to pay more attorney's fees for his failure to cooperate.  The Court may or may not award us the fees, but at least the Court will be made aware of his bad behavior and perhaps it will persuade XXX to come to the table to negotiate.

 

我的想法是，我只要child support和我的fair share，没想过要多拿。他上班，供房子并不宽裕，我也理解。但是分居后（是我带着小孩搬出去的）他一分child support也没给过，的确也十分不负责任。但是我并没有想把他逼急了，也不想他把钱花在这种地方。真有这些钱，还不如多出来分给孩子。

 

请教大家，这个有必要file吗？谢谢。
