So you won't go to jail.  Whether or not you are civilly liable (pay damage to other party), depends on a lot of things.  The legal case is nuisance.  https://en.wikipedia.org/wiki/Nuisance

Now the most important things for you to do is DO NOT LIE.  All conversation between your plumber and you are discoverable by the other party.  Only those conversation told to your lawyer or your insurnace company are confidential not discoverable by other party.  See https://en.wikipedia.org/wiki/Work-product_doctrine? 

Your home owner insurance company are contractually bounded to defend you.  So my suggestion is to either engage a lawyer or have insurance company do the investigation.
