想要Treaty是填8833吗

H1 Postdoctor researcher 退税填1040NR-EZ, 想要Treaty是填8833吗, 还是8233,或W-8?

还有1040NR-EZ Item J:
“Were you subject to tax in that country on any of the income that you claim is entitled to the treaty benefits”
Should I choose “yes” or “no”?
我理解上面这句话如下:
"你在中国是否需要对你免税的收入上税?"
因为我没在中国对这部分收入上税,所以应选"NO"?
请问是这样吗?
