also the reson you can not got your H1 approved is because your old visa is J1, if you switch j1 to h1 you need to go back China and serve 2 years then can get a chance to apply a h1 visa. it is the law.

so what you can do is to get a waive letter from Chiese embassy, (I do not know clearly how to waive the 2 year serve time, you can ask a lawer to help you on it).

then you are free to switch to H1.
