公平划分财产的因素中，有一个"The earnings or earning ability of the parties as related to: (A) a final division of property; and (B) a final determination of the property rights of the parties".

Earning就是一个人的现在工资。
Earning Ability是看个人的经历和教育程度。即使女方没有工作，如果也是高等教育，以前也工作过，起码earning ability可以按以前工作的工资算。

楼主所混淆的，是把没有earning和没有earning ability混淆起来。法官不是机器人，美国的系统是辩论双方，不会说女方现在没有工作，男方就不提earning ability. 如果女方显得主动，会给法官一个好印象，在孩子财产问题上，有很多好处。

当然，女方也可以死赖着不工作，但是没有律师会建议“不要去工作，否则你会吃亏”这种很绝对的建议。
