发广告传真要付$500罚款吗？

发广告传真要付$500罚款吗？

急问，我自己有一个小公司在加州，通过发传真打广告，传真号码是从网上搜寻来
的。一家麻州的公司回信说这样做违反联邦通讯委员会的TCPA(Telephone Consumer
Protection Act)法案，要我直接付他$500， 否则告诉到法庭，那时有可能要加倍
付罚金。

我的问题是
1)我是否应付罚款
2)如果是，应否付给他个人，还是等法庭的消息
3)如果要出庭，我是否要去麻州？罚款是否包括对方的律师费和交通等其他费用？
