1. You can go to court and get a court order about this matter. The court would most likely rule the child stay where he has been because changing his location may cause disturbance for his life.
2. Your agreement with your ex-wife should have mentioned in case she or you need to relocate, how the child would be arranged. It's not too late to do that, better discuss with her and settle this down peacefully.
3. Ask your son what he prefers to do and try to respect his opinion.

A. you son can come to spend summer with you every year;
B. your son can choose to come to you every break he has from school.
