Insurance claim is what you made against the other driver with the insurance company. Closing insurance claim is the company's internal business. You can sue the driver in court if you don't like it.

Legal case is what you made against the other driver, the other insurance company will defend according its contract with the driver. You will base your case on the legal claim of negligence.

Legal claim != insurance claim.
